Terms of service

Terms governing the services of New Mind s.r.o. and the personal data processing policy. This document takes effect on the date of publication.

1. Introductory provisions

These terms govern the relationship between the provider, New Mind s.r.o., registered office at Bělehradská 858/23, Vinohrady, 120 00 Prague 2, Company ID 03579409, VAT ID CZ03579409, registered in the Commercial Register (Municipal Court in Prague, section C, file 233858) – the "provider" – and the customer ordering dedicated servers, virtual servers, colocation or related services (the "customer"). By ordering a service the customer confirms they have read and agree to these terms.

2. Orders and conclusion of contract

A contract is concluded by submitting an order and its confirmation by the provider. After the proforma invoice is paid, the provider provisions the service and sends access credentials to the given e-mail. The customer is responsible for the accuracy of the order details.

3. Prices and payment terms

Service prices are listed on the provider's website excluding VAT. The provider is a VAT payer; VAT is charged at the statutory rate of 21%. The customer pays in advance for the selected billing period based on a proforma invoice. A tax document is issued upon receipt of payment. The service is active for the entire prepaid period.

4. Operation and availability

The provider operates the services in a TIER III datacenter and guarantees availability at an SLA of 99,9 %. Availability is monitored continuously. The provider may perform necessary maintenance; planned outages are announced in advance.

5. Rights and obligations

The customer undertakes to use the service in accordance with applicable law and fair-use principles. Operating content contrary to the laws of the Czech Republic is prohibited. The provider offers technical support by e-mail and phone on a 24/7 basis.

6. Term and termination

The service is arranged for the selected prepaid period and renews upon further payment. Either party may terminate the service at the end of the prepaid period. A consumer has the right to withdraw from the contract within the statutory period under the Civil Code.

7. Personal data protection (GDPR)

The provider processes personal data in accordance with Regulation (EU) 2016/679 (GDPR) and Act No. 110/2019 Coll. The data controller is New Mind s.r.o.. We process identification, billing and contact data and data necessary for operating the service – for the purpose of concluding and performing the contract and meeting legal obligations. We do not share data with third parties except where required by law. 8. Final provisions

Matters not governed by these terms are subject to the law of the Czech Republic. The provider reserves the right to update these terms; the current version is always available on this website.
